Adopted building codes

Clear Creek County adopted the 2024 International Code series together with Colorado's 2025 Wildfire Resiliency Code, with local amendments that keep county electrical review and add wildland-urban-interface provisions. Design to the 2024 IRC, not an older edition.

Zoning — M-1 Mining District

Both claims sit in the county's M-1 Mining District. Residential use in M-1 is governed by Section 7 of the zoning regulations rather than by the residential-district tables, so read Section 7 before you assume a setback or a permitted use.

Structural design criteria

Clear Creek County sets ground snow load by elevation and does not allow reductions. The surveyed boundary runs from about 8,000 ft at the north toe to about 8,580 ft at the south corner, so 65 psf is the floor here and the upper ground sits above the published 8,250 ft band — the county's site-specific determination governs. Treat 65 psf as a minimum, not the answer.

Water supply and well permitting

There is no water tap here. The house runs on a permitted well, and the permit class available to a parcel this size is the first question to close — it can change the whole program.

On-site wastewater (septic)

Clear Creek County administers septic permitting under its own OWTS regulations, backed by Colorado Regulation 43. Soils and setbacks here usually decide the house footprint, not the other way around.

Access, grading, and erosion control

Roughly 80% of the driveway is built and engineered civil drawings are already in hand — the reason this parcel skips the most expensive surprise on mountain ground. The standards those drawings answer to are below.

Ponds, stocking, and surface water

Soda Creek runs about 50 yards north-west of the north boundary. A trout pond is achievable and it is a three-agency exercise: storage and evaporation are water-rights questions, stocking is a wildlife license.

Title, claim records, and licensing

Patented lode claims are recorded differently from platted lots. These are the tools that produce the mineral survey numbers, patent records, and assessor schedule numbers — and the lookup that confirms an engineer's license is live.

The workflow, in order

On mountain ground the sequence matters more than the schedule. Each step gates the next, and the first five decide what the house can be. Durations and costs are directional 2026 ranges for Front Range mountain counties — confirm against the county's current fee schedule.

    Boundary and topographic survey

    In hand

    Establish the legal claim lines and contours. Lode claims are irregular, so nothing downstream can be sited without this.

    Geotechnical and soils investigation

    Buyer's scope

    Test pits for bearing capacity, frost depth, rock, and groundwater. Usually paired with the septic soil evaluation to save a mobilization.

    Water supply determination

    Partly in hand

    Get the DWR determination and well permit before anything else is designed. Two test holes here are already logged at 202 ft and 221 ft.

    Framing and foundation sized to the county's snow determination for the chosen pad elevation (65 psf or higher on this parcel), site wind, seismic category, and the geotech recommendations.

High-mountain design priorities

What experienced builders at 8,000–8,600 ft solve first, and why.

Water first, always

In Colorado, a house is only as legal as its water. Confirm the well permit class before you spend a dollar on architecture — it is the one constraint no design can engineer around.

Let the septic pick the house site

Soils and setbacks are inflexible; floor plans are not. On steep mountain ground the leach field, not the view, usually decides where the foundation goes.

Buy the access before the acreage

Road building is the single largest unbudgeted line item on mountain land — commonly $70–90 per linear foot of new cut. Existing engineered access is worth more than any finish package.

Design to snow, then to wind

At 65 psf or more, roof geometry, drift accumulation, and where snow sheds onto entries and driveways all become structural decisions, not aesthetic ones.

Class A roofing, ignition-resistant siding, ember-resistant vents, enclosed eaves, and defensible space are cheap on paper and expensive as a retrofit — and they move insurance from unavailable to obtainable.

Solve power and comms with the site plan

Off-grid means the array's solar window, battery room, generator setback, and Starlink sky view are site decisions made alongside the driveway, not afterthoughts.

Build for winter access and staging

Frozen ground, mud season, and a short pour window compress the schedule. Sequence excavation and concrete to the season, not to the contract date.
